Memtastic (a brand owned and operated by 1016 Investments LLC, "we," "us," or "our") respects your privacy. This Privacy Policy describes how we collect, use, retain, and delete personal information when you use the Memtastic application and related services, including optional Smart Notifications (SMS/MMS/RCS). This policy is designed to be readable alongside our Terms of Service. This policy is not legal advice; consult qualified counsel for your specific situation.
The following sections apply specifically to the Smart Notifications messaging program (carrier / 10DLC context).
When you opt in to Smart Notifications, we collect your mobile phone number and any name or contact information provided during the registration process on our platform.
We use your information exclusively to provide the "Smart Notifications" service you have requested. This includes sending memory-related photos, personalized conversational prompts, and deep-links to the Memtastic application to drive engagement with your saved content.
No mobile information will be sold or shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
You can cancel the messaging program at any time. Simply send STOP to our long code. After you send the keyword "STOP" to us, we will send you a final message to confirm that you have been unsubscribed. After this, you will no longer receive SMS/MMS/RCS messages from us. If you wish to join again, you may sign up through the Memtastic application settings.

The following sections describe the broader Memtastic product (household memories, chat, AI features, and account deletion).
We collect information you provide (for example, phone number for sign-in, optional email for recovery, name, date of birth where required, and content you upload such as photos and chat messages). We also derive information from your use of the service (for example, transcripts stored as structured session events, product telemetry, and AI context artifacts used to personalize conversations within a household). For household accounts, some content is visible to other members on the same subscription according to memory visibility settings and our access rules.
Consumer-friendly framing: We sometimes describe data as "Type 1" (information you clearly supply) versus "Type 2" (signals and narrative context the product builds). This framing helps explain the experience. It is not a substitute for how U.S. state privacy laws define personal information, which can include derived data if it identifies or is reasonably linkable to you.
You may request deletion of your Memtastic account from Profile settings when you are viewing your own account (not when an Account Admin is editing another member's profile on their behalf). Deletion is confirmed in a second step because it is irreversible for sign-in and for certain classes of data described below.
Memories you own. Before you confirm deletion, you may choose whether to allow Memtastic to automatically assign ownership of memories you own to another household member based on who has the most qualifying chat activity on each memory, with your Account Admin as a fallback. If you turn this off, or if no eligible recipient exists (for example, you are the only member), memories you own may be removed from the household using a soft-delete pattern aligned with our technical specifications.
What we remove or disconnect promptly. When you delete your account, we take steps to delete or disconnect your account-level chat history tied to your user id, purge AI identity artifacts stored under your user-scoped Memory Bank scope, remove Adaptive Prompt optimization rows tied to your user id where applicable, cancel pending smart-notification tasks tied to your user, mark your user record with a deletion timestamp, and disable sign-in for your credentials.
When you delete a memory, a photo, or a conversation, it is removed from our live systems immediately. When you delete your account, it is deactivated immediately and permanently deleted after 30 days.
We keep backup copies of your data so that a failure on our side cannot lose your family's memories. Deleted data can remain in those backups for up to 31 days after it leaves our live systems, and is then permanently gone. Backups are stored encrypted in Google Cloud data centers in the United States, in more than one location. They exist only to recover from data loss; they are never used for any other purpose and are not accessible through the Memtastic app.
Restoring a soft-deleted account (where available) may not restore all AI-learned personal context that was purged at deletion time.
Account Admin restriction. If you are the Account Admin for a household that still has other active members, self-service deletion may be blocked until those members are removed or a future administrative transfer flow is available—this reduces the risk of stranding billing and household data without an owner.
Depending on where you live, you may have rights to access, correct, delete, or opt out of certain processing of personal information under state comprehensive privacy laws (for example, California residents may have rights under the CPRA). How you exercise rights may depend on verification, exceptions for security and legal compliance, and whether data is reasonably necessary to complete transactions you requested. We implement security measures designed to protect personal information. Access to production systems is limited to authorized personnel and service configurations appropriate to the sensitivity of the data.
